An electronic signature (eSignature) is any electronic mark — a typed name, a drawn signature, or a click-to-sign action — that shows a person's intent to agree to a document. A digital signature is a separate, certificate-based technology built on public-key cryptography. ThemiSign offers electronic signatures; it does not currently issue certificate-based digital signatures.
In most cases, yes. In the United States, the ESIGN Act (2000) and the Uniform Electronic Transactions Act (UETA) give electronic signatures the same legal standing as a handwritten signature, provided the signer intends to sign, consents to sign electronically, and the record is retained. ThemiSign captures that intent and consent, along with a timestamped audit trail, for every signature.
ThemiSign is built to align with the ESIGN Act and UETA — the two laws that govern electronic signatures in the U.S. Neither requires third-party certification; compliance comes from following the legal requirements, which is what our consent capture and audit trail are designed to do. We don't yet hold certifications such as SOC 2 or ISO 27001, and we don't currently offer eIDAS qualified or advanced electronic signatures for EU-regulated use cases.
Every action on a document — created, sent, viewed, signed, completed — is logged with a timestamp, the signer's IP address, and a hash of that event. Once signing is complete, this becomes a certificate you can download alongside the signed PDF.

Documents are transmitted over encrypted connections, and every signing event is recorded to the audit trail described above. We're a growing startup and are working toward formal security certifications; in the meantime, we're glad to answer specific security questions directly.
